TERMS AND CONDITIONS FOR BOOKING ACCOMMODATION SERVICES

  1. INTRODUCTION

This document regulates the general conditions for booking accommodation online through www.italianluxuryhh.com (“Website”) of SGE 2018, SL, Calle Irlanda, 8 – Residencial Faro Park n ° 114 – Playa Blanca 35580 Lanzarote, CIF: B76317437 (hereinafter “SGE 2018”).

Any particular terms and conditions that may be applicable are made available to the customer before the booking is formalized.

Notwithstanding the foregoing, please note that these terms and conditions apply to any type of accommodation booking made with SGE 2018 by any means, including telephone, direct sales, etc.

  1. BOOKING CONDITIONS AND PRICE

At the time of booking, the customer must keep in mind that it is mandatory that there is at least one person over the age of 18 per booking.

At the time of booking it is necessary that the Customer informs SGE 2018 of the number of guests to stay as this circumstance will determine the type and rate of the apartment. The client should be aware that children over the 1 years of age pay the same rate as an adult.

When the Customer makes a reservation through the Website, the rates indicated in the search results are the applicable rates. All prices refer to complete apartments. In the event that, once the booking has been formalized, an additional adult is requested after the booking, SGE 2018 can make available, where possible, an additional bed in the booked apartment at an additional cost of 20 euros per person per day.

The price indicated before acceptance of these Terms and Conditions and payment of the booking, that is, before the Customer is bound by any contract or payment obligation, is definitive and complete and includes the price of all the selected products and all taxes applicable.

In case of unexpected changes or problems with the booking SGE 2018 will automatically contact the Customer for approval / instructions, before specifying a change.

The price does not include any unspecified service in addition to extras such as telephone calls, transfers, parking, etc.

SGE 2018 reserves the right to charge a security deposit of 150 € per apartment as reported at the time of booking, to cover any damages in case they occur. This deposit will be returned if the apartment is in perfect condition and no accidents have occurred.

  1. RESERVATION CONFIRMATION

The contract stipulated between the Customer and SGE 2018 will come into force when SGE 2018 will provide the Customer with a written confirmation of the booking by e-mail.

Therefore, after making the reservation, the Customer will receive a confirmation email, which will also include the payment conditions, the cancellation policy, the address of the apartment, our telephone numbers and all the necessary and useful information for the reservation.

  1. BOOKING CANCELLATION
    1. Standard rate: The customer has 24 hours from the booking to cancel it without incurring any penalty. In case of cancellation within 30 days from the arrival date, SGE 2018 is authorized to return 50% of the booking to the customer. In case of cancellation after 30 days from the date of arrival, the customer will not have any right to a refund or modification of the dates themselves.
  2. Promotional rates: they are not refundable or changeable in any case.

The customer can consult the cancellation conditions applicable to his reservation in the confirmation email.

To cancel your booking, please contact us in writing, by e-mail, by phone or on the web address http://italianluxuryhh.com/index.php/le-tue-prenotazioni/ by entering the confirmation code received by e-mail. You can consult our contact details on the website.

  1. NO-SHOW

If the customer does not show up at the apartment on the scheduled arrival date, without notice, SGE 2018 will always charge 100% of the stay.

  1. BOOKING MODIFICATION
    1. Modification of the reservation by the customer

In the case of standard rates, the customer can modify his reservation, provided there is availability, up to 40 days before the arrival date at no additional cost. After this period, in case of changes, the first night of stay already paid by the Customer will be charged.

In the case of promotional rates, changes are not allowed and are not refundable.

You can contact us by email or by phone with the changes you want, such as adding nights to your booking, the number of people or changing the type of apartment. You can consult our contact details on the website.

It should be kept in mind that if you need extra nights it will depend on the availability at that time.

If you wish to reduce the number of nights booked, the Customer may be subject to a cancellation penalty, but we will always do our best to assist you.

  • Modification of the reservation during the stay by the Customer

If the Customer wishes to reduce his stay and leave the apartments before the date scheduled for the end of the stay, SGE 2018 will not refund the amount of the remaining nights until the originally scheduled departure day.

If the customer wishes to extend the stay, he must contact SGE 2018 as soon as possible to confirm availability and the applicable rate.

  • Change of booking by SGE 2018

In the event that SGE 2018, for reasons of force majeure or unforeseen circumstances, changes a reservation, it will be immediately communicated by e-mail or by telephone to the Customer. SGE 2018 will offer, where possible, an apartment with the same characteristics as the one booked.

If the customer does not agree with the proposed alternative, he can cancel his reservation without being subject to the cancellation policy, receiving the amount paid so far. In this case, SGE 2018 assumes no other responsibility for the total or partial cancellation of the reservation.

  1. PAYMENT METHOD

In the case of non-refundable or refundable reservations, the total amount of the same will be charged to your credit card at the time of booking.

Payments can be made in cash, by credit / debit card (Visa, MasterCard or American Express) or by bank transfer. In the case of a bank transfer, please note that your bank may charge you a commission for an international transfer.

In case of payment by bank transfer, please note that the reservation will not be confirmed until receipt of the bank transfer receipt by e-mail and the reservation will be subject to confirmation of the deposit which must have been paid at least 3 days in advance, in the case of national transfers, and at least 15 days in advance, for international transfers.

  1. EXCLUSION OF THE RIGHT OF WITHDRAWAL

We inform you that the right of withdrawal for distance contracts provided for by Directive 2011/83 / EU of the European Parliament and of the Council of 25 October 2011 on consumer rights is excluded, among other things, in contracts for the supply of accommodation. Therefore, the right of withdrawal does not apply to accommodation services provided by SGE 2018.

  1. ACCOMMODATION AND STAY STANDARDS

Below is a description of the SGE 2018 rules for accommodation and stay. In the event that the customer or any of the guests or companions does not comply with any of the rules specified herein, SGE 2018 reserves the right to unilaterally request, according to its own criteria, the customer who leaves the accommodation, without in any case having right to any compensation or indemnity by SGE 2018.

  • Arrival Departure

Arrival:The apartment will be available from 15: 00h. If for any reason you arrive before this time, please inform SGE 2018 and we will try to receive them in advance when possible.

Please note that for arrivals after 22: 00h, there is an additional charge of € 20.00 which will be paid, together with your accommodation, to the person responsible for your reception. In case of arrivals between 22:00 and 00:00 it is essential to inform SGE 2018 by e-mail. PROGRAMMING COMMUNICATIONS, MODIFICATIONS OR TELEPHONE CANCELLATIONS ARE NOT ALLOWED.

Departure:The departure must be made before 10: 00h, in case you want to leave later, check availability on arrival or before the departure date. Upon request and according to availability, it is possible to stay in the apartment until 13: 00h with an additional cost of € 20.00 per apartment. For departures after 13: 00h will be charged as an additional day of stay.

  • Identification

Upon arrival at the accommodation of SGE 2018, it is essential that the customer and all guests identify themselves with their identity card.

Similarly, in the case of payments by credit card, the Customer must present the same credit card used for the booking together with the identity card of the cardholder. If you are not the owner, you must present an authorization accompanied by a photocopy of the owner.

  • Number of guests

The number of people per apartment cannot exceed the maximum number of people included in the booking, except for children under 2 years. Cots are available on request with an additional charge of € 10 per cot per night.

If SGE 2018 finds that the number of guests exceeds the number of people included in the booking, 20 euros per night will be charged for each additional guest.

  • Pets

Pets are not allowed, except in cases where SGE 2018 expressly authorizes it. In these particular cases, the Customer must contact SGE 2018 via e-mail to process this authorization, which must be previously approved.

  • Cleaning
    The apartments are cleaned only before the client arrives. For stays longer than 9 days, an additional cleaning will be done every 7 days.

At the end of the stay the customer is required to leave the apartment in reasonable condition. Otherwise you will be charged the cost of an additional cleaning of 20 euros.

  • Behavior

Loud music and parties are totally prohibited. Rest hours are from 22: 00h to 09: 00h and must be respected.

When booking an apartment, the customer must be aware that in case of scandal or too loud music and neighbors complain to SGE 2018 and / or call the police, this type of event can result in immediate eviction regardless of time of day or night. In the event that neighbors or the police call the emergency number of SGE 2018, the Customer will have to pay € 150, the card provided at the time of booking or the deposit paid at the time of booking as a guarantee.

We appreciate your understanding and collaboration in this matter and we hope you understand that these rules are necessary for a coexistence based on respect.

We expect correct civic behavior on the part of the customer and all the people who accompany him. If any of the guests does not behave correctly and responsibly, SGE 2018 reserves the right to ask the customer and his companions to leave the apartment immediately, without the right to future claims or any type of compensation. This results in the loss of the remaining accommodation and, if applicable, the security deposit.

  • Furniture and cleaning

The customer undertakes to keep the furniture and all the contents of the apartment in the same condition in which it was found on arrival.

SGE 2018 will have the right to request those customers who do not comply with the cleaning criteria, or who cause damage to the furniture due to improper use, compensation for the same (minimum € 50); the credit card provided in the booking or the amount paid as a deposit will act as a guarantee.

We expect correct civic behavior on your part and on the part of all those who accompany you.

SGE 2018 reserves the right to request a deposit of € 150 per apartment upon arrival, to cover any damages in the event that they occur. SGE 2018 can block the amount of the deposit on the customer’s credit card or, in the event that the customer does not have a credit card, the payment will be made in cash. In the event that the customer does not pay the requested deposit, SGE 2018 reserves the right to prohibit the customer and / or guests from entering the apartment. This deposit will be returned upon departure if the apartment is in perfect condition and no accidents have occurred.

  • Handing over the keys

The customer must leave the keys in the reception of the apartments or in the mailbox on the ground floor (if the departure takes place before 09:00).

The loss of the keys carries a cost of 50 €.

In addition, in the event that the staff must move outside the established reception hours (from 9:00 to 21:00) for reasons beyond the control of SGE 2018 following improper use of the apartment by the Customer, forgetting, loss of keys or negligence, the customer will have to pay a cost of 25 euros.

  • Do not smoke.

By law it is strictly forbidden to smoke in the apartments (included in the balconies). In case of detection that the customer has smoked in the accommodation, the penalty is € 90 and will be charged to the customer’s credit card.

  1. RESPONSIBILITY OF SGE 2018

SGE 2018 is not responsible for any direct or indirect damage that may occur as a consequence of the improper use of the apartment by the customer, including, but not limited to, the loss due to fire, theft or criminal behavior. In case of violation, SGE 2018, at its discretion, will have the right to ask the customer to leave the apartment and will charge the customer, by credit card or cash, the amount equivalent to the broken or deteriorated material, provided that the customer expressly accepts.

  1. THE PRIVACY POLICY

SGE 2018 recognizes the importance of protecting the personal information of its users and customers and of keeping it confidential and secure in accordance with current legislation.

This privacy statement describes the processing of data of our users and customers collected through www.italianluxuryhh.com (“Site”), by telephone or through any other communication channel, therefore it is recommended that our users and customers read carefully this privacy statement to provide SGE 2018 with personal data that may require them to be fully informed, in particular about the obligation to provide data and the purposes of their processing.

We also inform you that in the future changes to this privacy statement may be made in order to ensure constant compliance with applicable law to adapt it to new legislation or jurisprudence.

These General Conditions are governed, to the extent permitted by applicable law, by Spanish law. In addition, to the extent permitted by applicable law and international agreements, the parties agree to submit to the jurisdiction of the Courts of Arrecife, Spain, for any matter relating to the interpretation, execution or application of these Terms and Conditions, expressly renouncing any jurisdiction that may correspond, provided that the applicable law does not establish a specific mandatory jurisdiction.

  • If the customer is a consumer

These General Conditions are governed by Spanish law or, if you reside outside Spain, by the law of the country of residence.

Any dispute relating to these General Conditions will be subject to the jurisdiction of the Customer’s place of residence and, in the event that such jurisdiction is not required by law, at the Customer’s choice, that of his residence or the domicile of Grupo Roisa.

Note that it is possible to use the online dispute resolution platform for services provided by European Union companies (the “ODR Platform”), which the European Commission makes available to all its citizens at the following linkhttp://ec.europa.eu/consumers/odr/

Therefore, consumers of the European Union can send their complaints to SGE 2018 SL through the ODR Platform using the e-mail address of SGE 2018.

We inform you that this e-mail address can only be used for the purpose of sending us your complaint through the ODR platform. Therefore, any e-mail sent to the addressinfo@sgeinvestment.comoutside the procedure established through the ODR Platform it cannot be followed.

  1. APPLICABLE LAW AND JURISDICTION

These General Conditions are governed, to the extent permitted by applicable law, by Spanish law. In addition, to the extent permitted by applicable law and international agreements, the parties agree to submit to the jurisdiction of the Courts of Madrid, Spain, for any matter relating to the interpretation, execution or application of these Terms and Conditions, expressly renouncing any jurisdiction that may correspond, provided that the applicable law does not establish a specific mandatory jurisdiction.
